Terms of Sale

Welcome to Male3D.com. These Terms of Sale ("Terms") govern all purchases made through this website. By placing an order, you agree to be bound by these Terms.

1. Original Artwork

Unless otherwise stated, every artwork offered by Male3D is an original, handcrafted creation by the artist.

Original paintings, ACEO cards, and handcrafted bookmarks are individually created by hand. Natural variations in texture, brushstrokes, sculpted details, and artistic characteristics are part of the handmade process and are not considered defects.

2. Pricing

All prices are listed in U.S. Dollars (USD).

Prices are subject to change without notice until an order has been successfully placed and payment has been received.

Applicable sales tax will be collected where required by law.

3. Payment

Payment must be successfully authorized before an order is processed.

Male3D reserves the right to refuse or cancel any order due to pricing errors, payment issues, suspected fraud, or product availability.

4. Fraud Prevention

To protect both customers and the artist, Male3D may delay, verify, refuse, or cancel any order suspected of fraud or unauthorized payment activity.

Additional information may be requested to verify the purchaser's identity before shipment.

5. Packaging

Original paintings are carefully packaged to help ensure safe delivery and typically include:

  • Original handcrafted artwork
  • Certificate of Authenticity
  • Protective packaging
  • Artist presentation materials, when applicable

Packaging methods may change without notice as improvements are made.

6. Shipping

Orders are shipped through reputable shipping carriers.

Shipping charges are calculated during checkout. Tracking information will be provided when available.

Estimated delivery dates are provided for convenience only and are not guaranteed. Male3D is not responsible for shipping delays caused by carriers, weather conditions, customs, or circumstances beyond our control.

7. Shipping Insurance

Original paintings are shipped with shipping insurance whenever available.

If your package arrives with visible damage, please photograph the unopened package before opening it.

If damage is discovered after opening, you must notify Male3D within 48 hours of delivery and provide photographs of:

  • The shipping box
  • All packaging materials
  • The damaged artwork
  • The shipping label

This documentation is necessary to assist with any shipping insurance claim. Failure to provide timely documentation may affect our ability to pursue a claim with the shipping carrier.

8. Risk of Loss

Risk of loss transfers to the purchaser upon confirmed delivery by the shipping carrier.

If an insured shipment is damaged during transit, Male3D will reasonably assist the purchaser with the carrier's insurance claim.

9. Returns

Because every original artwork sold by Male3D is a unique, one-of-a-kind creation, all sales are considered final.

Returns or replacements will only be considered if:

  • The wrong item was shipped.
  • The artwork was damaged during shipping.
  • The artwork differs substantially from its description or photographs.

Requests must be submitted within 48 hours of delivery. Returned artwork must remain in its original condition. Unauthorized returns will not be accepted.

10. Order Cancellations

Orders may be cancelled before shipment. Once an order has shipped, it may not be cancelled.

Refusing delivery does not cancel the purchase. Customers remain responsible for all shipping charges, return shipping charges, insurance costs, and any non-refundable payment processing fees resulting from refused deliveries.

11. Payment Reversals and Chargebacks

Customers agree to contact Male3D first to resolve any concerns before initiating a payment dispute or chargeback whenever reasonably possible.

Ownership of the artwork transfers only after payment has been successfully received and is not subsequently reversed due to fraud, unauthorized payment, or a successful chargeback.

If payment is reversed after shipment for reasons including, but not limited to, unauthorized payment, fraud, or chargeback, the purchaser agrees to immediately return the artwork in its original condition upon request.

If the artwork is not returned, Male3D reserves all rights and remedies available under applicable law to recover possession of the artwork or its full purchase price.

Male3D may provide shipping records, delivery confirmation, photographs, correspondence, and other documentation to payment processors, financial institutions, shipping carriers, law enforcement, or courts when necessary to investigate or resolve payment disputes.

12. Product Photography

Every reasonable effort is made to accurately represent each artwork through professional photography.

Because color and brightness vary between monitors, tablets, and mobile devices, slight differences between the images displayed on the website and the actual artwork are normal and are not considered defects.

13. Certificate of Authenticity

When included, the Certificate of Authenticity confirms that the artwork is an original Male3D creation.

Loss, damage, or misplacement of the certificate does not affect ownership of the artwork.

14. Copyright and Intellectual Property

The purchase of an original artwork transfers ownership of the physical artwork only.

The artist retains all copyrights and intellectual property rights, including but not limited to reproduction, publishing, licensing, merchandising, promotional, and commercial rights.

Artwork may not be copied, scanned, reproduced, distributed, published, or used for commercial purposes without the artist's prior written permission.

Male3D reserves the right to photograph and display sold artwork for portfolio, promotional, archival, educational, and marketing purposes.

15. Product Availability

Because each original artwork is unique, availability is limited.

If an item becomes unavailable due to an inventory or technical error, the order will be cancelled and any payment received will be refunded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Male3D shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the purchase, shipment, ownership, or use of any artwork.

Male3D's total liability shall not exceed the amount paid for the purchased artwork.

17. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Indiana, without regard to its conflict of law principles.

Any legal action arising from these Terms or the purchase of artwork shall be brought in the appropriate state or federal court located within the State of Indiana, unless otherwise required by applicable law.

18. Changes to These Terms

Male3D reserves the right to update or modify these Terms of Sale at any time without prior notice.

The version posted on this website at the time an order is placed will govern that purchase.
